New Bond Wordings for Saskatchewan Ministry of Highways and Infrastructure

On Friday, November 6, 2015, the Ministry of Highways and Infrastructure of Saskatchewan advised that effective immediately, they will be moving away from their Indemnity bond wording and implementing a separate 50% Performance Bond and 50% Labour & Material Bond wording. These new wordings are similar to the current CCDC wordings being used but have been modified slightly to meet the Ministry’s requirements. The new wordings have been reviewed by Ministry of Highways, Saskatchewan Heavy Construction Association and the Surety Association of Canada to get all parties input on the move to the new bond wordings.

"It has been a culmination of close to twenty years of lobbing the various provincial governments and this change is a win for all parties to the bond." says Western Surety’s CEO Scott Donald.

A copy of the new bond wording can be found on the Ministry of Highways and Infrastructure of Saskatchewan website (see the Ministry’s release below). They have also been updated on Western Surety’s E-Services. As this change involves the move from a 50% combined performance and labour & material bond exposure to a 50% performance bond and a 50% labour & material bond exposure, there will be some bond rate adjustments. Please advise your members of the following changes to the Ministry website. Performance Bond, Procedural Guide to the Performance Bond and the Labour and Material Payment Bond documents have been posted to the Ministry Website. These documents replace the Indemnity bond which has been removed from the website.

Please share this information with others in your company or membership. The approved the bonds and Procedural Guide to the Performance Bond are effective immediately and shall be used in all future contracts. Make it a habit to always pull a new template off the Ministry website to make sure you always have the most current edition of the file.
